2. Learned counsel for the appellants seeks permission to withdraw the present application in view of the fact that

Patna High Court CR. APP (SJ) No.4444 of 2024(3) dt.07-11-2025 2/2 cognizance has already been taken under the provisions of SC/ST Act and hence the application would not be maintainable.

3. Permission is accorded.

4. Accordingly, this application is dismissed as withdrawn. However, the liberty is granted to the appellants that in case the appellants surrender before the learned Court below within a period of four weeks for seeking regular bail, the learned Court below would consider the same on its own merits, preferably, on the same day, without being prejudiced by this order.
