JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-04-2024 The present writ petition has been filed seeking the following relief:- "That this writ application is being filed for issuance of appropriate writ for setting aside the order dated 08.08.2023 passed by Commissioner, Tirhut Division, Muzaffarpur in ICDS Appeal No. 173/2022 whereby the appeal preferred by the Private Respondent has been allowed.

And Further to quash the letter dated

Patna High Court CWJC No.15776 of 2023(2) dt.08-04-2024 2/2 19.08.2023 issued by C.D.P.O., Sonbarsa, Sitamarhi whereby the petitioner has been directed to redivert the amount in the account of C.D.P.O. Sonbarsa which has already been withdrawn and used by the petitioner for the centre."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of filing a civil suit before the learned civil court of competent jurisdiction. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
