The petitioner is languishing in custody since 15.06.2019 in a case registered for the offences punishable under Sections 341, 342, 323, 427, 435, 385, 506/34 of the Indian Penal Code and Section 17 of Criminal Law Amendment Act.
The prosecution case as per the written report of Sanjay Kumar submitted to Station House Officer of Rafiganj Police Station is to the effect that on 06.06.2019 at 9.30 P.M. on the brick kiln of the informant three persons came, demanded
Patna High Court CR. MISC. No.61325 of 2019(2) dt.27-11-2019 2/3 extortion, assaulted the labourers and put the tractor of the informant on fire due to non-fulfillment of the extortion demand.
It is submitted by learned counsel for the petitioner that the accusation is omnibus and general and investigation has already been concluded. It is further submitted that the FIR has been lodged against unknown and during investigation suspicion was raised against the petitioner. It is further submitted that similarly situated co-accused Saroj Kumar @ Saroj Yadav has been granted bail by a Co-ordinate Bench of this Court vide order dated 30.09.2019 passed in Cr. Misc. No. 47222 of 2019. Though, the petitioner is accused in three other cases but statement has been made in paragraph 3 of the petition that petitioner is on bail in two cases.
Learned APP submits that the petitioner is accused in other cases of similar nature.
Considering the suspicious nature of accusation, no recovery being made from the possession of the petitioner and the fact that the co-accused has been granted bail, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
