2. The petitioner apprehends his arrest in connection with Buxar Nagar P.S. Case No. 394 of 2023, registered for offence punishable under sections 363/366(A) of the Indian Penal Code and Sections 8/12 of the POCSO Act.
3. As per FIR, the daughter of the informant went to school, but she did not return. The informant, while searching his daughter, came to know that the petitioner, after alluring his daughter, took away her with a bad intention.
4. The learned counsel for the petitioner has submitted that the entire allegation is false. The victim, in her statement recorded under Section 164 of the Cr.PC, did not support the
Patna High Court CR. MISC. No.68783 of 2023(2) dt.02-11-2023 2/2 prosecution case. The petitioner is a person of clean antecedent.
5. On the other hand, the learned APP has opposed the prayer for bail and submitted that at the time of occurrence, the victim was minor.
Considering the fact that the victim, in her statement recorded under Section 164 of the Cr.PC, did not support the prosecution case and the petitioner is a person of clean antecedent, the prayer for anticipatory bail of the petitioner is allowed. Let him, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 4th A.D.J.-cum-Special Judge POCSO Act, Buxar in connection with Buxar Nagar P.S. Case No. 394 of 2023, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) Mahesh/- U T
