JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Khaira P.S. Case No. 94 of 2019, disclosing offences under Sections 341, 323, 324, 307, 504, 354, 447 and 34 of the Indian Penal Code.

Allegation against the petitioner and others is of abusing the informant and assaulting him and specific allegation against this petitioner is that he assaulted the informant by means of spade.

Submission of learned counsel for the petitioner is that petitioner and informant are closely related and due to family dispute this false case has been lodged and injury sustained by the informant was also found simple in nature. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court CR. MISC. No.62149 of 2019(2) dt.15-10-2019 2/2 this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamjui, in connection with Khaira P.S.
