The petitioner seeks bail in connection with Haspura P.S. Case No.37 of 2019/Sessions Trial No.224 of 2019/271 of 2019 registered under Sections 302/34 of the Indian Penal Code. The accusation is that the informant Sunil Chaudhary was informed by his brother Anil Chaudhary that his mother Lalo Devi is lying in her hut sustaining cut injury on her neck. Thereafter, the informant and his brother reached at the hut of their mother and found her dead sustaining cut injury on her neck and the blood was fallen on the ground. Before four days, Ram Pravesh Chaudhary alias Fatu Chaudhary (petitioner) had given threatening to the mother of the informant saying that she is hurdle in partition of the land. Learned counsel appearing on behalf of the petitioner submits that except suspicion, there is no material against the petitioner to connect him in the alleged crime. The petitioner has no criminal antecedent and is in custody since 20.05.2019. Further submission is that the similarly situated co-accused Vijay Choudhary alias Vijay Kumar Choudhary has already been granted bail by a Bench of this Court vide order dated 13.09.2019 passed in Criminal Misc. No.44976 of 2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-XI, Aurangabad, in connection with Haspura P.S. Case No.37 of 2019/Sessions Trial No.224 of 2019/271 of 2019.
