Mr.Rina Sinha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 28-02-2023 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

The petitioner is in custody in a case registered for offences punishable under Sections 147, 148, 149, 302, and 379 of the Indian Penal Code.

The allegation against the petitioner is that the son of the informant was assaulted by means of lathi, danda and iron rod due to which he succumbed to the injury. There is allegation of snatching the gold chain also from the neck and rupees fifty thousand from the pocket of his son. It is submitted by the learned counsel for the petitioner that the petitioner has falsely been implicated in this case and the specific allegation of assault is against co-accused

Patna High Court CR. MISC. No.67169 of 2022(2) dt.28-02-2023 2/2 Diggaj Kumar. The allegation is general and omnibus against the petitioner. It is also submitted that other co-accused persons are getting privilege of bail and the case of the petitioner comes within the purview of better footing.

The learned Additional Public Prosecutor for the State vehemently opposed the prayer for bail.

Considering the aforesaid submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bachhwara P.S. Case No. 77 of 2022 to the satisfaction of the Chief Judicial Magistrate, Begusarai.
