====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners seek bail in connection with Manpur P.S. Case No. 102 of 2025 dated 09.06.2025 (G.R. No. 3257 of 2025) registered for the offences punishable under Sections 319(2), 318(4), 336(3), 338, 340(2), 61 read with Section 3(5) of the B.N.S., 2023 and Sections 66C and 66D of the I.T. Act, 2000.
3. As per the prosecution case, the petitioners were allegedly involved in committing cyber crime in the villageSarbahadi offering fake loan in the name of Bajaj Finance. It is further alleged that from the possession of the petitioner no. 1 Pradeep Kumar, one mobile phone used for cheating with
Patna High Court CR. MISC. No.67054 of 2025(2) dt.13-10-2025 2/3 WhatsApp data showing fake ID Card, photo and other documents and from the possession of the petitioner no. 2, Bhola Kumar, one mobile phone with two sims, order sheets containing mobile numbers and Email IDs names, State, etc., were recovered.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. It is submitted that nothing was recovered from the possession of the petitioners. They were arrested only on the basis of suspicion. It is further submitted that nobody had made any complaint regarding cyber crime committed by the petitioners. It is further submitted that no independent witness has put his signature on the seizure list. It is further submitted that the police took confessional statement of the petitioners which is inadmissible under Sections 25 and 26 of the Indian Evidence Act. No incriminating article has been recovered from the possession of the petitioners. It is submitted that the other co-accused person, namely, Rahul Kumar, has already been granted bail by another Co-ordinate Bench of this Court in Cr. Misc. No. 59421 of 2025 vide order dated 11.09.2025. The petitioners have clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioners are in
Patna High Court CR. MISC. No.67054 of 2025(2) dt.13-10-2025 3/3 custody in this case since 10.06.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Nalanda at Biharsharif in connection with Manpur P.S. Case No. 102 of 2025 with further condition:- (I) The petitioners are directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
