JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 This is an application for grant of anticipatory bail in connection with Complaint Case No. C-607 of 2018 disclosing offences under Sections 498A of IPC and Section 4 of the Dowry Prohibition Act.

Petitioner happens to be the husband of the complainant and there is allegation of demand of motorcycle, Freeze, Cooler, T.V. and for that, she was assaulted and ousted her from the house.

Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted. The complainant is a Teacher and as such, she herself does not want to live with the petitioner.

Further submission of the learned counsel for the petitioner is that he is still ready to keep her with dignity and care, if she wants to live with him.

Nobody appears on behalf of the opposite party no.2/complainant in spite of repeated calls.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M. Sherghati, Gaya, in connection with Complaint Case No. C-607 of 2018 with condition that if the opposite party no.2 is ready to reside with the petitioner, he has to keep her with dignity and care.
