JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
The name of these petitioners came in confessional statement of co-accused Vikash Chaudhary @ Vikesh Choudhary, who has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 15.7.2019 passed in Cr. Misc. No. 43387/2019. Moreover, according to the prosecution case itself, nothing was recovered from
Patna High Court CR. MISC. No. 67174 of 2019(2) dt.04-11-2019 2/2 possession of the petitioners.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Buxar/concerned court in connection with Dhansoi P.S. Case No. 67/2019.
