The petitioner is languishing in custody in a case registered for the offences punishable under Sections 413, 414, 467, 468, 471, 472, 420 of the Indian Penal Code.

There is recovery of stolen motorcycle and SIM of different companies from the house of the petitioner and petitioner was arrested from the spot.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.72506 of 2024(2) dt.17-10-2024 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with the seized vehicle or the sim cards. Moreover, no one has come forward to claim the seized vehicle. The charge-sheet has already been submitted. The petitioner is languishing in custody since 09.05.2024.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gaya Muffasil P.S. Case No. 390 of 2024, subject to the conditions that (i) one of the bailors will be the close family member of the
