BAJANTHRI ORAL ORDER 20-12-2021 In the instant petition, petitioner has sought for the following reliefs:- For issuance of an appropriate writ/writs, order/orders, direction/directions, rule or command, especially in the nature of Certiorari, quashing the recommendation of District Compassionate Committee, East Champaran (Motihari), in its minutes/proceeding, dated 10.06.2019, so far as it relates to Respondent no.7 who was recommended to be appointed on Compassionate ground in the concerned Road construction Department under the category of Grade-III without following the necessary and mandatory requirements of the Compassionate Appointment Rules, ignoring the pathetic condition of other dependents of the deceased and the petitioner further prays

Patna High Court CWJC No.20516 of 2019(8) dt.20-12-2021 2/2 that the respondents be restrained not to proceed with the casual and mechanical recommendation of District Compassionate Committee, East Champaran (Motihari), dated 10.06.2019, escaping the critical and pathetic condition of the petitioner, being widow mother of the deceased and/or any other relief(s) to which the petitioner may be found entitled thereto as this Hon'ble Court may deem just and proper under the backdrop of the facts and circumstances of the present case.

The petitioner's husband late Suresh Singh stated to have died in the year 2005. 7th respondent was appointed on 07.11.2019 on compassionate ground. The petitioner has filed this application on the score that 7th respondent is not taking care of petitioner. Such a contention cannot be appreciated in respect of compassionate appointment dated 25.01.2010 in favour of 7th respondent. Thus, the petitioner has not made out the case.

This petition stands dismissed.
