2. Lastly, vide order dated 14.02.2023 passed in Cr.Misc. No. 72879 of 2022, the bail petition of petitioner was dismissed for default.

3. As per prosecution case, total 330 kg. of Ganja was recovered from a truck, of which, this petitioner was Khalasi.

4. Trial Court report reveals that after framing of charge on 31.03.2023, out of five prosecution witnesses, one witness has already been examined and rest four witnesses are yet to be examined, for whose production, the concerned S.S.P. has been directed on 19.09.2024 and bailable warrant of arrest has been issued against rest four prosecution witnesses.

5. Considering the nature of accusation and progress of trial, the prayer for bail of petitioner is rejected. However, since petitioner is in custody since 21.09.2021, the Trial Court is directed to conclude the trial as early as possible preferably within a period of one year from the date of receipt/production of copy of this order.
