JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-10-2019 The petitioner is holding the substantive post of Headmaster and on account of seniority he was authorized to work as Drawing and Disbursing Officer. Now the respondents have decided not to allow this petitioner any further to work as Drawing and Disbursing Officer.

There is no substantive post of Drawing and Disbursing Officer. It is only an interim arrangement. The substantive post of the petitioner is Headmaster and he is still holding the post of Headmaster.

Therefore, the Court is not inclined to interfere with

Learned counsel appearing on behalf of the petitioner submits that the petitioner has already represented the District Education Officer in relation to his grievance as to Drawing and Disbursing Officer. He submits that the writ petition may be disposed of with a direction to the District Education Officer, Sheohar to dispose of the representation dated 24.8.2019. Without entering into the merit of the claim of the petitioner, the writ petition is disposed of with a direction to the respondents to dispose of the representation of the petitioner dated 24.8.2019 at the earliest preferably within a period of sixty days from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
