The petitioner seeks bail in connection with Nayagaon P.S. Case No. 08 of 2024 instituted for the offence under Sections 341, 323, 324, 325, 307, 379, 504, 506 & 34 of the Indian Penal Code.

As per prosecution case, allegation against the petitioner is of assaulting the informant by means of khanti and pistol due to which his hand got fractured.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 08-07-2024. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. It is submitted that there is land dispute between the parties. It is alleged that petitioner has assaulted the informant by means of Khanti and pistol on his hand but from perusal of the injury report, it would reveal that injury is caused on skull and leg though it is found to be grievous in nature. There is delay of four days in lodging of the FIR, without any plausible explanation. It is submitted that earlier also petitioner was implicated by the informant in connection with Nayagaon P.S. Case No. 05 of 2024.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case and period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court CR. MISC. No.70732 of 2024(4) dt.20-11-2024 3/3 two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nayagaon P.S. Case No. 08 of 2024.
