2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 307, 379, 447, 504 and 34 of the Indian Penal Code.

3. The allegation in the first information report is that as many as 10 accused persons including the petitioner assaulted the informant and her family members.

4. Learned counsel for the petitioner submits that perusal of the first information report would show that besides general and omnibus allegations, there is specific allegation on coaccused, Bhola Paswan and Naresh Paswan of having assaulted the husband of the informant with iron rod causing injuries to him. There is case and counter case and there is no specific allegation

Patna High Court CR. MISC. No.66133 of 2025(2) dt.19-09-2025 2/2 on the petitioner. It is further submitted that similarly situated coaccused, Awadhesh Paswan and Golu Paswan have been granted anticipatory bail by a co-ordinate Bench of this Court vide orders dated 17.05.2024 and 04.08.2023, passed in Cr. Misc. Nos.26988 of 2024 and 43201 of 2023 respectively.

5. Learned APP opposes the grant of anticipatory bail to the petitioner.

Taking into consideration the facts aforesaid and also considering that specific allegation of assault is on different accused persons and similarly situated co-accused have already been granted anticipatory bail, let petitioner, above named, who has no criminal antecedent, in the event of his arrest or surrender before the learned court below within a period of four weeks from today, be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Gaurichak P.S. Case No.322 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
