2. The petitioner seeks bail in connection with Ghoswari P.S. Case No. 75 of 2025 dated 07.06.2025 registered for the offences punishable under Sections 126(2), 115(2), 308(2), 308(3), 352, 351(2) read with Section 3(5) of the B.N.S., 2023.

As per the prosecution case, the petitioner and the other co-accused persons are alleged to have demanded Rs. 10,00,000/- (Rupees Ten Lacs) as ransom ('rangdari') while the work of the Flood Control Department was being carried out and they are also alleged to have assaulted the Pocklan Operator, namely, Anuj Kumar.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the alleged occurrence took place on 12.05.2025, 17.05.2025, 25.05.2025 and 03.06.2025 and the F.I.R. has been lodged on 07.06.2025 and there is delay of lodging the F.I.R., and no explanation for such delay has been given by the prosecution. It is further submitted that the informant and his staff are the residents of different districts and they are completely unknown to the petitioner and after several days of the alleged occurrence, at the instance of the local persons who have inimical terms with the petitioner, the present false case has been lodged against the petitioner and other coaccused persons. The petitioner has no concern with the alleged offence.

No incriminating article has been recovered from the possession of the petitioner. It is further submitted that the other co-accused person, namely, Umakant Yadav @ Loha Singh @ Uma Kant has already been granted anticipatory bail by another Co-ordinate Bench of this Court in Cr. Misc. No. 67708 of 2025 vide order dated 24.09.2025. The petitioner has one criminal antecedent in which he is on bail as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 17.06.2025.

5. Learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.65849 of 2025(2) dt.13-10-2025 3/3 opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned I/C S.D.J.M., Barh, Patna, in connection with Ghoswari P.S. Case No. 75 of 2025.

7. The application stands allowed.
