Petitioners apprehend their arrest in Mufassil P.S. Case No.124 of 2019 registered under Sections 341, 323, 324, 354 and 34 of the Indian Penal Code.

The informant named the petitioners and alleged that some dispute arose between two sides for fixing gate and windows. Khyanand Singh is alleged to have torn the clothes of the wife of informant and Birendra Singh assaulted him with knife which hit on the hand of the informant. Learned counsel for the petitioners submits that there is a series of litigation between both sides. On account of fixing

Patna High Court CR. MISC. No.66693 of 2019(2) dt.24-10-2019 2/2 gate and windows, the informant picked up a quarrel and lodged the case making false and frivolous allegation. The injury found on the hand of the informant is superficial and simple in nature. Having considered the facts and the nature of allegation made against the petitioners and the fact that there appears that the dispute arose due to land dispute, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Mufassil P.S. Case No.124 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
