No. 10970 of 2024, which has stood dismissed for want of prosecution vide order dated 06.08.2024.

The learned counsel for the petitioner has submitted that since information about listing of the aforesaid case on 06.08.2024 was not received by the learned counsel for the petitioner by way of

Patna High Court MJC No.3339 of 2024(3) dt.17-01-2025 2/2 text message, he could not appear before this Court when the case was called out for hearing leading to dismissal of the aforesaid writ petition on account of non-prosecution, hence a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing C.W.J.C. No. 10970 of 2024 to its original file.

The present petition stands allowed.
