2. The petitioner seeks bail in a case registered for offence under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

3. As per prosecution case, informant stated that friends of his son Nitin Kumar, namely Nitish Kumar, Vinod Rai (petitioner), Sagar Kumar and some other friends, had called him to see a horse race. Thereafter, they took him to Mallikpur, where other co-accused persons and 4-5 unknown persons killed his son by firing on his head.

4. Learned counsel for the petitioner submits that informant is not an eye-witness of the occurrence and he has not

Patna High Court CR. MISC. No.66061 of 2025(3) dt.24-11-2025 2/2 disclosed source of information as to how he came to know about involvement of petitioner and others in the alleged occurrence. During trial, five prosecution witnesses including the informant have been examined but none of them have said about petitioner's involvement in the alleged offence. Similarly situated co-accused persons have been granted bail by this Court, vide order dated 18.11.2025 passed in Cr.Misc. No. 73145 of 2025. Petitioner is in custody since 27.01.2025.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the nature of accusation and period of custody, prayer for regular bail of petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge VIII, Vaishali at Hajipur in Sessions Trial No. 193 of 2025, arising out of Raghopur P.S. Case No. 22 of 2025.
