2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 21(c), 22(c), 25 of the Narcotic Drug and Psychotropic Substances Act.

3. The case of the prosecution is that from a pick-up van, altogether 2,150 bottles of codeine Phosphate & Triprolidine HCL Syrup, each of 100 ml was recovered. The pick-up van was being driven by Abhishek Kumar and the petitioner is friend of Abhishek Kumar and he was sitting in the said pick-up van.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. Nothing has been recovered from the conscious possession of this petitioner. From perusal of the seizure list as

Petitioner is neither the driver nor the owner of the said vehicle. From perusal of the FIR as well, it will transpire that the police has inquired about the codeine from Abhishek only. It implies that there is no suspicion against the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 20.01.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Parbatta P.S. Case No. 14 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-I, Bhagalpur.
