2. The petitioners apprehend their arrest in connection with Patory P.S. Case No. 326 of 2022 registered for the offence punishable under Sections 147, 149, 341, 323, 324, 325, 307, 354A, 379, 380, 447, 448, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, petitioner No. 1 along with his father wrapped Gamcha around the neck of the informant with the intention to kill him and petitioner No. 2 along with other co-accused persons has assaulted other members of the prosecution party.

4. Learned counsel for the petitioners submits that the parties are neighbours. Allegation of assault is general and omnibus. No specific allegation of assault has been made against the petitioners. There is case and counter case and both sides have sustained injuries.

Petitioners claim clean antecedents.

5. Learned APP for the State opposes the prayer for grant of anticipatory bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within six weeks from today, let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Samastipur, in connection with Patory P.S. Case No. 326 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
