The petitioners have renewed his prayer for bail in a case under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, a total of 7350 litres of country liquor was recovered from a truck of which the petitioners are the driver and khalasi.

The earlier application for bail of the petitioners was rejected vide order dated 10.5.2022 (Annexure-1) passed in Cr. Misc. no.61365 of 2021 giving liberty to the petitioners to renew their prayer for bail after six months. The petitioners have remained in custody since 12.7.2021.

Having heard learned counsel for the parties and taking into consideration the liberty granted to the petitioners in the earlier order of rejection dated 10.05.2022 and the period in custody of the petitioners, the Court directs the petitioners to be enlarged on bail in connection with Aurangabad Town P.S. Case no. 272 of 2021(G.R. No.888 of 2021) on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise 1st, Aurangabad, Bihar.
