2. The petitioner has assailed the order dated 30.06.2016 (Annexure-2) to the extent the same relates to his transfer from Vaishali to Gopalganj. It is the case of the petitioner that he was posted at Sub Divisional Hospital, Mahua, in the District of Vaishali, on 30.06.2016 and within one year of his posting, he was being sent to Gopalganj without any valid reason.
3. This matter was taken up on 24.08.2017 and considering the averments made in the writ application, this Court
Patna High Court CWJC No.11682 of 2017 dt.18-11-2019 2/2 had directed for stay of the said order dated 30.06.2017 till further orders.
4. By virtue of the interim order passed on 24.08.2017, evidently, the petitioner has remained posted at Sub Divisional Hospital, Mahua, and has now completed more than three years.
5. In such circumstance, the order dated 24.08.2017 granting stay stands vacated. The respondents shall be at liberty to relieve the petitioner for his joining at Gopalganj by virtue of the impugned Notification dated 30.06.2017. It will be however open for the respondents to post the petitioner to any other place if in the meanwhile certain developments have taken place requiring a decision afresh for transfer and posting of the petitioner at appropriate place.
