ANJANA MISHRA ORAL ORDER 09-03-2018 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
A 2nd Supplementary show-cause has been filed on behalf of the State of Bihar in which they have categorically stated in Annexure 2 that as per roster the petitioner, Abu Kumar cannot be appointed on the post in the unreserved category and, therefore, the order of this Court stands fully complied with. Learned counsel for the petitioner, however, submits that the entire action of the opposite parties is against the settled principles and they have adopted a pick and choose method for implementation in the case of the said petitioner being Abu Kumar which has been cleverly ignored by them.
Having considered the entire facts and circumstances of the case and that there is substantial compliance of the order passed by this Court, the contempt application stands disposed of
Patna High Court MJC No.5253 of 2012 (11) dt.09-03-2018 2/2 with liberty to the petitioner Abu Kumar to approach the authorities with a representation for the consideration of this case, if at all, tenable under law.
