2. The petitioner is in custody since 19.05.2023 in connection with Gurua P.S. Case No. 229 of 2023 registered for the offence punishable under Sections 395 of the Indian Penal Code.

3. As per the prosecution case, the petitioner has been found involved in committing dacoity in a finance company.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The petitioner is not named in the F.I.R, his name transpired in the confessional statement of the co-accused Manish Kumar which has no evidentiary value. He further submits that similarly situated co-accused has already been granted bail by a co-

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail. He submits that the petitioner has been identified in the T.I. Parade.

6. Considering the facts and circumstances of the case and also the fact that similarly situated co-accused Mahesh Sharma has been granted bail, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Gurua P.S. Case No. 229 of 2023.

7. The petitioner is directed to mark his attendance in Gurua police station on every Sunday.
