====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-10-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Birpur (Balua Bazar)P.S. Case No.161 of 2019 registered under sections 354/34 of IPC and 66 E (IT Act-2008). The allegation against the petitioner, as per the first information report, is that the petitioner used to tease the daughter of the informant namely Rambha Kumar and uploaded her objectionable picture on the face book.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case inasmuch as both the victim girl and the petitioner was having love affair and some joint photographs of petitioner and the victim girl was uploaded with the consent of the victim girl.

Patna High Court CR. MISC. No.62056 of 2019(2) dt.18-10-2019 2/2 Learned counsel further submits that there was no intention on part of the petitioner to embarrass the victim girl. The informant who is the father of the victim girl was not liking the relationship of petitioner and the victim girl and lodged the present case. Learned counsel further submits that the petitioner is a student aged about 20 years and his career will be at stake.

Having regard to the submissions made by the parties and taking into consideration the fact that the petitioner is studying and his age is about 20 years and he was in love affair with the victim girl, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner, above named, in the event of arrest or surrender before the learned Court below within a period of four weeks from today shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Birpur, Supaul in connection with Birpur (Balua Bazar) P.S. Case No. 161 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anil Kumar Sinha, J) Anjula/- U
