ANJANA PRAKASH ORAL JUDGMENT Date: 06-07-2015 Heard learned counsel for the Petitioners and the State. The Petitioners seek quashing of the order of cognizance dated 1.4.2010 passed by the Chief Judicial Magistrate, Sadar, Motihari, in East Champaran (Motihari) Muffassil P.S. Case No. 183 of 2004 (Tr. No. 2898 of 2012) on the ground that in the facts of the case, no offence is made out.

However, on looking at the contents of the case diary, this Court does not accept said submission.

Patna High Court Cr.Misc. No.44616 of 2012 dt.06-07-2015 2/2 Hence, the application is dismissed.

The Trial Court is directed to conclude the Trial expeditiously without granting unnecessary adjournment to any party for which reason, he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order in connection with East Champaran (Motihari) Muffassil P.S. Case No. 183 of 2004 (Tr. No. 2898 of 2012), to the Superintendent of Police, East Champaran at Motihari, and the Superintendent of Police, East Champaran at Motihari, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
