JUSTICE KHATIM REZA ORAL ORDER 17-09-2025 Heard learned counsel for the petitioners; learned Additional Public Prosecutor for the State and learned counsel for the informant, who has appeared suo motu.
2. The petitioners apprehend arrest in connection with Raniganj PS Case No.124 of 2025 dated 27.03.2025, instituted under Sections 126(2), 127(2), 329(3), 329(4), 115(2), 118(1), 109, 103(1), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. The prosecution case, in brief, is that on the alleged
Patna High Court CR. MISC. No.65860 of 2025(2) dt.17-09-2025 2/3 date of occurrence all the FIR named accused persons came at the informant's house and started abusing due to previous dispute. On protest, accused Chandeshwar Mandal dragged the informant's mother, Shashikala Devi by holding her hair. Kundan Kumar and Anila Devi assaulted Shashikala Devi and accused, Chandeshwar Mandal cut the tongue of the Shashikala Devi with a knife and stabbed multiple times on her neck causing serious injuries. Thereafter, Kundan Kumar Mandal assaulted Shashikala Devi with a rod on her head. When the informant's wife, Karishma Kumari came to save Shashikala Devi, the accused persons also assaulted her. The informant took her mother to Raniganj Hospital where she was declared dead.
4. Learned counsel for the petitioners submits that the specific allegation of assault is against Chandeshwar Mandal and Kundan Kumar that they assaulted the mother of the informant. It is also submitted that the police after investigation submitted final form in the case and the petitioners were not sent up for trial but the learned Magistrate differing with the final form took cognizance against them also. Lastly, it is submitted that the petitioners have no criminal antecedent.
5. Learned APP as well as learned counsel for the informant has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, 1st, Araria, in Raniganj PS Case No.124 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
7. The application stands allowed.
