2. The petitioner apprehends his arrest in connection with Riga P.S. Case No. 439 of 2024 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. As per the first information report, while the informant was on duty, he saw one person coming on an erickshaw and upon seeing the police, he tried to escape, however, on chase he was caught, but finally he escaped taking advantage of bushes. From the said e-rickshaw, 69 liters of Nepali Saufi liquor was recovered and the liquor and e-rickshaw were seized.

4. Learned counsel for the petitioner submits that the name of the petitioner has been implicated on suspicion as he earns his livelihood by working as a driver of e-rickshaw, whereas he has no connection either with the seized liquor or

5. In view of the fact that the seizure has not been made from the conscious possession of the petitioner and he is not connected either with the seized liquor or the e-rickshaw, I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, Sitamarhi, in connection with Riga P.S. Case No. 439 of 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
