The petitioner is languishing in custody since 27.6.2018 in a case registered for the offences punishable under Section 379 of the I.P.C.

The prosecution case is that on theft being committed of three motorcycles of the informant, FIR was lodged against unknown. Name of the petitioner sprang up during investigation.

It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner. It is further submitted that petitioner is accused in nine other cases of similar nature but he is on bail in all those cases. Learned APP submits that the petitioner is having criminal antecedent.
