Petitioner is apprehending his arrest in connection with Maner PS Case No.612/18 , registered for offences punishable under Sections 323, 308, 379, 504/34 of the Indian Penal Code. As per FIR, petitioner and other accused persons have assaulted the informant and others and there is specific allegation against petitioner of assault by rod on head of the informant.
Submission of the learned counsel for the petitioner is that there is case and counter case between the parties and neither before the court below nor in the case diary injury has been mentioned.
Heard learned A.P.P. and the learned counsel for the
Patna High Court CR. MISC. No.62083 of 2019(3) dt.20-11-2019 2/2 informant, who have opposed the prayer for bail on the ground that the petitioner was referred to the PMCH also for treatment. .
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of six months and on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Susri Nutan Kumari , J.M., Danapur, Patna in connection with Maner P.S. Case No.612 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With the above direction, this application is allowed. (Vinod Kumar Sinha, J) chn/- U T
