2. The petitioner seeks bail in connection with Didarganj P.S. Case No. 95 of 2020 registered for the offence punishable under Section 414 of the Indian Penal Code and Section 30(a)/36 of the Bihar Prohibition and Excise Amendment Act, 2018.

3. The recovery is of 100 litres of illicit country made liquor from the different vehicles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is in jail since 07.09.2024.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna City in connection with Didarganj P.S. Case No. 95 of 2020, with further condition:

(i) As a condition of the order, the petitioner will mark attendance in Didarganj Police Station, Patna City, DistrictPatna on every Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
