2. The petitioner apprehends his arrest in connection with Bokhra P.S. Case No. 110 of 2025, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.
3. On the secret information regarding making and selling of illicit liquor by the petitioner along with other accused persons, police team reached at the marked place and recovered total 21 litres of country made liquor along with 200 litres Mahua Ghol from the hutment behind the house of petitioner and his brother co- accused Vishnu Sahni.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case at the instance of Chaukidar. Recovery of illicit liquor has been made from a hutment which is an open place and accessible to all.
Patna High Court CR. MISC. No.69432 of 2025(2) dt.13-10-2025 2/2 No incriminating material has been recovered from the conscious possession of the petitioner. He has no concern with the seized liquor. There is no independent witness to the seizure-list. Petitioner has no criminal antecedent. Petitioner undertakes to cooperate in the investigation and trial. Similarly situated coaccused, namely, Vishnu Sahni has been granted anticipatory bail by this Court vide order dated 13.10.2025 passed in Cr. Misc. No. 68394 of 2025.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the Petitioner, above-named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Exclusive Excise Court No.-I, Sitamarhi in connection with Bokhra P.S. Case No. 110 of 2025, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
