JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-01-2019 As argued by the learned counsel for the respective parties, it is apparent from the record that an arbitrary procedure has been adopted by the authorities of Rajkiya Uttarkramit Madhyamik Vidyalaya, Bhagwanpur, Ratti, Vaishali with regard to admitting the students in I. Sc. (Agriculture) Curriculum on pick and choose basis, belonging to the sessions between 2012 to 2016 and without any reason, the students of the Session 2010 have been left out and the petitioner also belongs to the Session 2010. The petitioner claims that he is having a meritorious record and has passed the matriculation examination in Ist Division, hence the petitioner is required to be accommodated in the forthcoming Sessions of I. Sc.

Having regard to the facts and circumstances of the present case as also considering the fact that the respondents have not been able to demonstrate as to how the aforesaid method resorted to is not perverse and arbitrary, this Court is left with no option but to direct the respondents to accommodate the petitioner in the forthcoming Session of I. Sc. (Agriculture) Course.

The writ petition is disposed of with the aforesaid direction.
