2. Heard the parties.

3.The petitioner seeks bail in connection with Sahayak Khajanchi P.S. Case No. Case No. 109 of 2025 registered for the offence under Section 64 and 318(4) of the BNS, 2023.

4. As per the prosecution case, the petitioner on the pretext of marriage, is said to have established physical relation with the informant.

5. The petitioner is in custody since 4.7.2025.

6. Learned counsel for the petitioner submits that from the FIR, it appears to be case of consensual sex and the petitioner, without prejudice to his case, is ready to hand over a demand draft of Rs. 50,000 to the learned counsel for the informant.

Though, learned counsel for the informant has vehemently opposed the application of the petitioner but he accepts the offer of the learned counsel for the petitioner and accordingly accepts the demand draft of Rs. 50,000/- in this Court on behalf of the informant without prejudice to the rights of the informant.

8. Considering the aforesaid facts, this application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea/concerned Court below in connection with Sahayak Khajanchi P.S. Case No. 109 of 2025.

10. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court

Patna High Court CR. MISC. No.66909 of 2025(4) dt.10-10-2025 3/3 on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
