2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 17(a), 18 (a), 21 (a), 23 (a), 27 (a)/29 of the N . D. P . S Act.

3. As per the prosecution case, petitioner is alleged to be indulged in dealing with NDPS substances.
4. Learned counsel for the petitioner submits that petitioner has been made accused in this case only on the basis of confessional statement of other co-accused namely Bijay Mandal from whose possession the incriminating material was recovered. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned \Court of Sessions Judge Cum Special Judge (NDPS Act), Kishanganj in connection with Thakurganj P.S. case No. 37 of 2023 , subject to the conditions laid down under section
