2. The petitioner seeks bail in connection with Gurua P.S. Case No. 72 of 2025 instituted for the offences punishable under Sections 310(4), 310(5), 111(1) of the BNS and Sections 25(1-B) a, 26 and 35 of the Arms Act.
3. As per allegation in the FIR, some arms as well as cash money has been recovered from the possession of the accused persons including the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case merely on the basis of mere suspicion. He submits that the name of the petitioner has come only on the basis of disclosure made by co-accused persons
Patna High Court CR. MISC. No.67605 of 2025(2) dt.24-09-2025 2/3 namely, Satish Mandal @ Baba @ Raju Bhuiyan, Santosh Kumar @ Santosh Mehta and Bali Bhuiyan. He further submits the petitioner has not been arrested from the place of occurrence and nothing has been recovered from the conscious possession of the petitioner. Petitioner has got one more case as stated in para 3 of the petition is in custody since 13.04.2025.
5. Learned APP for the State opposes the prayer for bail.

From perusal of the FIR and impugned order of the learned Additional Sessions Judge-III, Sherghati, Gaya dated 28.07.2025, it appears that on the basis of self statement of the informant Police-sub-Inspector namely, Md. Sarfaraz Imam, FIR has been registered under Sections 310(4), 310(5), 111(1) of the BNS and Sections 25(1-B) a, 26 and 35 of the Arms Act against five named co-accused persons including the present petitioner. It also appears that the petitioner was not arrested at the spot and no recovery has been made from the conscious possession of the petitioner. The name of the petitioner has been surfaced in this case from the arrested accused persons. Similarly situated co-accused person namely Bali Bhuiyan @ Lulha @ Dilip Bhuiyan has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 64508 of 2025 vide order
Patna High Court CR. MISC. No.67605 of 2025(2) dt.24-09-2025 3/3 dated 18.09.2025, so considering all these aspects of the case and submissions of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.
7. Accordingly, the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Sherghati, Gaya in connection with Gurua P.S. Case No. 72 of 2025.
