2. The petitioner is in custody in connection with Jamalpur P.S. Case No. 30/2024 registered for the offence punishable under Section 414 of the Indian Penal Code.

3. As per allegation in the FIR, it is a case of recovery of 94 stolen mobiles from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that merely on the basis of suspicion, police recovered unclaimed bag beneath the seat of the petitioner and presumed that said article belong to this petitioner and petitioner has no concern with the recovered mobile set. He further submits that a

Patna High Court CR. MISC. No.71920 of 2024(2) dt.31-01-2025 2/2 similarly situated accused persons has been granted bail vide order dated 19.08.2024 passed in Cr. Misc. No. 56134 of 2024. Petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 02.07.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the aforesaid facts and circumstances of the case as well as the fact that a similarly situated accused person has been granted bail vide order dated 19.08.2024 passed in Cr. Misc. No. 56134 of 2024, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul (Lakhisarai) in connection with Rail Jamalpur P.S. Case No. 30 of 2024.
