JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-11-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Muffasil (Aurangabad) P.S. Case No. 89 of 2023 registered for the offences punishable under Sections-341, 323, 308, 354, 504, 34 of the Indian Penal Code.
Allegedly, while the informant was engaged in construction work of a community hall, the accused persons having armed with lathi, danda etc. came there and assaulted the informant and his labourers as a result of which, the informant sustained injury.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. He is a
Patna High Court CR. MISC. No.72126 of 2023(2) dt.07-11-2023 2/2 person of clean antecedent and the injury suffered by the injured person is simple in nature. There is case and counter case between the parties.
Learned Additional Public Prosecutor opposed the prayer for bail.
Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil (Aurangabad) P.S. Case No. 89 of 2023 , subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) A.K.V.//- U T
