The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No.136 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving secret information about keeping the Indian Made Foreign Liquor by the petitioner in village-Jokia and selling the same from there, the informant along with other police personnel reached there. On seeing the police vehicle, two persons started to flee away from there. On chase, one was apprehended, who disclosed his name Sanjeevan Kumar and also disclosed the name of the petitioner, who succeeded to flee away. On search, by the side

Patna High Court CR. MISC. No.61786 of 2019(2) dt.15-10-2019 2/2 of the road, from the bush, one cartoon, containing 48 bottles of 180 ml. Indian Made Foreign Liquor, was recovered. Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot rather his name has been disclosed by the apprehended accused due to dirty village politics. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cumSpecial Judge, Excise Act at Begusarai,in connection with Bhagwanpur P.S. Case No.136 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
