3. Learned counsel for the appellants submits that in view of the letter No. 37(Anu) dated 11-01-2024, issued by the

Patna High Court MA No.657 of 2023(2) dt.19-01-2024 2/2 Executive Engineer, National Highway Division, Gaya, he does not wish to press this application any more, on account of it having become infructuous, since the Ministry (MoRTH) has sanctioned the settlement amount of Rs. 3,24,63,710.00/- vide letter dated 05-12-2023 and the same has already been released in favour of M/s Kumar A.S. Construction, vide letter dated 13-12-2023. Copy of the letter No. 37(Anu) dated 11-01-2024 has been produced by the learned counsel for the appellants, which is retained on record.

4. Accordingly, this Misc. Appeal is dismissed as withdrawn.
