2. The petitioner is seeking regular bail in connection with Rafiganj P.S. Case No. 98 of 2024 for the offences punishable under Section 380 of the Indian Penal Code.

3. As per allegation, the accused persons including the petitioner entered into the house of the informant and committed theft of his Oppo mobile phone. The petitioner was caught red handed on the spot.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered from his possession. The petitioner is a person of clean

Patna High Court CR. MISC. No.71243 of 2024(2) dt.29-11-2024 2/2 antecedent and is under custody since 20.03.2024. He has also submitted that on the exactly similar footing, co-accused Sushil Kumar has been granted bail by this Court vide order dated 01.08.2024 in Cr. Misc. No. 52294 of 2024.

Considering the above-mentioned facts and circumstances as well as clean antecedent of the petitioner, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Aurangabad (Bihar) in connection with Rafiganj P.S. Case No. 98 of 2024, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
