2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 191(2), 191(3), 190, 109(1), 103(1), 118(1), 61(2) and 352 of the B.N.S..
3. As per prosecution case, on 16.02.2025 at about 7 PM, all the F.I.R. named accused persons, including this petitioner, armed with deadly weapons, came to the house of informant and started abusing her. It is alleged that when husband of informant intervened, co-accused Subbe Yadav assaulted him by means of iron rod, co-accused Dharmendra Kumar assaulted on the head of Dewar (brother-in-law) of
Patna High Court CR. MISC. No.65912 of 2025(2) dt.18-09-2025 2/3 informant with Garasa and co-accused Saloni Kumari, Sampati Devi, Malti Devi and Pinki Devi assaulted informant with Farsa. During course of treatment, husband of informant died.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that specific accusation of assault is against other coaccused persons. So far as this petitioner is concerned, he is only named in the F.I.R. and no specific role has been attributed to him. This petitioner is only alleged to be member of the mob. Petitioner is not the assailant of the deceased. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs.
Patna High Court CR. MISC. No.65912 of 2025(2) dt.18-09-2025 3/3 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Jehanabad in connection with Barabar Tourism P.S. Case No. 16 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
