JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 This is an application for grant of anticipatory bail in connection with Jakkanpur P. S. Case No. 376 of 2019 disclosing offences under Sections 272, 273 and 120B of IPC and Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2018.
As per prosecution case, nine and half liters of liquor were recovered and one co-accused has been arrested, who disclosed the name of the petitioner, as his associates. Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused, there is nothing against him and though he is accused in one more case and that is not the similar type.
Further submission is that the other accused person Vikash Kumar having similar allegation has been granted
Patna High Court CR. MISC. No.62679 of 2019(4) dt.09-01-2020 2/2 privilege of anticipatory bail by a Co-Ordinate Bench of this Court, vide order dated 03.12.2019 passed in Criminal Misc. No. 55021 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise Act, Patna, in connection with Jakkanpur P. S. Case No. 376 of 2019.
