2. Earlier regular bail petition of the petitioner was rejected by this Court vide order dated 15.03.2023 in Cr. Misc. No. 52439 of 2022 but the fresh ground for renewing the prayer is that the petitioner has remained under custody for a period of more than two years and the pace of trial is not satisfactory. Out of 11 witnesses only 4 have been examined. He has submitted further that co-accused Niraj Kumar has been granted bail by a co-ordinate Bench of this Court and the case of the petitioner is on better footing to that of co-accused Niraj Kumar, in whose confessional statement, the name of the petitioner has transpired.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on

Patna High Court CR. MISC. No.70804 of 2023(5) dt.27-09-2024 2/2 furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM-III, Sikrahana, Dhaka, East Champaran at Motihari in connection with Ghorasahan P.S. Case No. 353 of 2021, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available on each and every date till conclusion of the trial.
