The petitioner seeks bail in a case registered under Sections 336, 418, 414 of the Indian Penal Code, Drug Cosmetic Act, 1940, Sections 18(A), 18(B) Rule 27(b)(ii), 28, 28(A) and 36 AC and Sections 8P & 22(b) of the NDPS Act, 1985.

Allegedly, 1.600 litres Codeine mixed syrup is recovered in this case.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-07-2019. Charge sheet has already been submitted. 1.600 litres Codeine mixed syrup is said

Patna High Court CR. MISC. No.61818 of 2019(2) dt.05-11-2019 2/2 to have been recovered in this case. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court vide order dated17-10-2019 passed in Cr. Misc. No. 63293 of 2019. There is no compliance of Section 100 of Cr.P.C. and Sections 42 & 50 of NDPS Act.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Sitamarhi in connection with Sonbarsa P.S. Case No. 155 of 2019.
