The petitioner has renewed his prayer for bail in a case under sections 304B and 34 of the Indian Penal Code. As per the prosecution case, the daughter of the informant who was married to the petitioner in the year 2014 was tortured and assaulted for nonfulfilment of the demand of dowry to the tune of Rs. 2 lacs. Ultimately she was done to death by the accused persons including the petitioner herein. The earlier application for bail of the petitioner was rejected vide order dated 24.03.2022 (Annexure-1) passed in Cr. Misc. no. 50358 of 2021 giving liberty to the petitioner to renew his prayer for bail after framing of charge or after six months, whichever is later. Charge has been framed in the trial Court and more than six months have passed since the order dated
Patna High Court CR. MISC. No.67252 of 2022(2) dt.07-12-2022 2/2 24.3.2022. The petitioner has remained in custody since 13.3.2021.

Having heard learned counsel for the parties and taking into consideration the liberty granted to the petitioner in the earlier order of rejection dated 24.03.2022 and the period in custody of the petitioner, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial No.315 of 2022 (arising out of Madhaurah P.S. Case no. 133 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge XI, Chapra, Saran.
