JUSTICE SANDEEP KUMAR ORAL ORDER 15-03-2023 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State. The petitioner seeks bail in connection with PTN - BRSR01P0001600322021 (N.D.P.S. Case) arising out of Rail Chapra Kacheri P.S. Case No. 156 of 2021 under Sections 401, 414 of the Indian Penal Code and Sections 20 and 20 of the N.D.P.S. Act.

Seen the report dated 27th January, 2023 of the Additional District and Sessions Judge I-cum-Special JudgeNDPS, Saran at Chhapra. He has reported that trial of the petitioner has started and one of the witness out of four witnesses have been examined and for appearance of rest of the witnesses bailable warrant has been issued.

Accordingly, the prayer of bail of the petitioner is rejected herewith.

The Superintendent of Police, Saran at Chhapra is directed to secure the attendance of all the witnesses on the date fixed so that the trial is concluded at the earliest.
