This application, for grant of anticipatory bail, arises out of Barbigha Police Station Case No. 211 of 2015, disclosing offences under Sections 448, 323, 504, 506, 380, 307/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. As a matter of fact, the informant happens to be man of several antecedents, which is evident from annexures-3 and 4. Further, the though the informant claimed that he was referred to PMCH but the injury report is not on the record. Moreover, co-accused Rupesh Kumar and Dhiraj Kumar

Patna High Court Cr.Misc. No.40134 of 2017 (2) dt.21-09-2017 have already been granted anticipatory bail by a co-ordinate Bench of this Court. Hence, the petitioner deserves the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sheikhpura, in connection with Barbigha Police Station Case No. 211 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
